Usage Policy & Disclaimer

Spanish Fork City has created a web site which is designed to provide residents access to Government departments, services, and programs. This Information Is Made Available as a Free Public Service, Without Express or Implied Warranties of Any Kind, and Subject to the Following Disclaimers:

  1. Accuracy and Continuity of Service. The City makes no guarantee of the completeness or accuracy of any information provided. It makes no promise or warranty to maintain or update this public service or information contained and made available to the public. The City may suspend or discontinue this service at any time, or it may elect to charge a fee for access or use. The user assumes the risk of verifying any materials used or relied on.

  2. No Warranties. The City disclaims any express or implied warranty in providing for public use its computer system and any materials, information, graphics, products, or processes contained therein. It makes no warranty, express or implied, nor assumes any responsibility in the use of this service or its contents for its accuracy, completeness, currency, its use for any general of particular purpose, nor that such items or use of such items would not violate or infringe rights of others. This service is provided on a strictly "as is" basis.

  3. External Links; Personal Opinions. City computer resources and materials may contain hypertext or other links to Internet or computer sites, not owned or controlled by the City, that may be of interest. From time to time, departments may wish to provide links to other sites that provide State or Federal Government information or additional information about the community, including festivals, cultural events, and local news. Spanish Fork City will allow links to other web sites that meet the following criteria:

    1. Web sites maintained by other Government entities;
    2. Web sites maintained by area Chambers of Commerce;
    3. Web sites maintained by entities which contract with the City;
    4. Web sites maintained by news media with an established presence in the community for a minimum period of twelve months;
    5. A web site maintained by an entity which promotes the economic welfare, tourism or businesses within the City.

     

    City will determine the location of all links to other web sites. The determination by the City will be final and non-appealable.

    Links to other computer systems are not supervised nor regularly reviewed by the City. Any information, endorsements of products or services, materials or personal opinions appearing on such external sites are not controlled, sponsored nor approved by the City. The City specifically disavows legal responsibility for what a user may find on another site, or for personal opinions of individuals posted on any site, whether or not operated by the City, established for the purpose of permitting free exchange of personal opinions or a "town hall" discussion.

  4. Copyright Limitations. The City has copyrighted the content of its web site. Copying or distributing information found here cannot be done without complying with United States copyright laws.

  5. Assumption of Risk of Use. A user of the City's web site for information made available for public use assumes the risk of use or reliance on such information. Neither the City, its employees or agents shall be liable for any damages for viewing, distributing or copying of materials on its sites made available to the public, including indirect, special, incidental, or consequential damages, even if advised of the possibility of such damages.

  6. Monitoring of System; No Expectation of Privacy. The City web site system is subject to monitoring at all times to assure proper functioning of the system, to provide security for the computer system's operation and information contained, to gather statistical information to better serve the public, to prevent unauthorized use, and to deter and investigate violations of law. There is no reasonable expectation of privacy in the use of this public computer system.

  7. Use of Social Media. One of the purposes of using social media is to present matters of interest to residents, businesses and visitors. The City encourages questions, comments, and concerns, keeping in mind this is a moderated online discussion site and not a public forum.

    Once posted, Spanish Fork City reserves the right to delete submissions that contain:

    1. Vulgar language;
    2. Personal attacks of any kind;
    3. Offensive comments that target or disparage any ethnic, racial, or religious group.

     

    Furthermore, the City also reserves the right to delete comments that are:

    1. Spam or which include links to other sites,
    2. Clearly off topic,
    3. Advocate illegal activity,
    4. Promote particular services, products, or political organizations,
    5. Infringe on copyrights or trademarks,
    6. Use personally identifiable medical information. The City recommends that the participants not share any medical information.

     

    The City does not retain any of the posts. Posts are retained or deleted based upon a schedule maintained by the site host.

  8. Utah Law and Jurisdiction. The materials are provided for public use on computer systems located within Spanish Fork City and for the use and benefit of citizens of Spanish Fork City, Utah. Any person choosing to use this system or seeking access to information or materials on this system is subject to Utah jurisdiction. Any dispute arising therefrom shall be decided under the laws and in the courts in Utah County, Utah.
